Arcan-Mafia — Terms of Service

1. Definitions

As used in these Terms of Service, the following terms shall have the meanings set forth below:

"Agreement"

means these Terms of Service, together with the Privacy Policy and any other policies incorporated herein by reference, as each may be amended from time to time.

"Game" or "Service"

means Arcan-Mafia, the browser-based persistent strategy game available at mafia.arcanum-forge.com, including all associated software, features, content, and functionality.

"Company," "we," "us," or "our"

means NodeCore LLC, the operator of the Game.

"Discord"

means Discord Inc. and its platform, services, and application programming interfaces used for authentication.

"Account"

means the player profile created upon your first login, associated with your Discord user ID.

"Virtual Items"

means any in-game currency, items, weapons, vehicles, crew members, properties, or other digital content that exists solely within the Game.

"User," "you," or "your"

means any individual who accesses or plays the Game.

"User Content"

means any content or input submitted by you within or in connection with the Game, including usernames and profile data sourced from Discord.

2. Acceptance of Terms

2.1   BY ACCESSING OR PLAYING THE GAME, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY THIS AGREEMENT IN ITS ENTIRETY. IF YOU DO NOT AGREE TO ALL TERMS AND CONDITIONS OF THIS AGREEMENT, YOU ARE NOT AUTHORIZED TO ACCESS OR USE THE GAME AND MUST IMMEDIATELY DISCONTINUE SUCH ACCESS.

2.2   Your use of Discord for authentication is separately governed by Discord's Terms of Service and Community Guidelines, which are incorporated herein by reference.

3. Description of Service

3.1   Arcan-Mafia is a browser-based idle-strategy game set in a 1930s–1960s mob era fictional world. Players create a persistent character, commit crimes, run timed operations, purchase items and properties, and compete on a leaderboard.

3.2   The Game is currently in active development. Features, game mechanics, balance, and content may change significantly without notice. Progress, items, and account data may be reset during development phases at the Company's discretion.

3.3   The Service is provided on an "as available" basis. The Company reserves the right to modify, suspend, limit, or discontinue all or any portion of the Service at any time, with or without prior notice, and without liability to any User.

3.4   Access to the Game may be restricted to invited users or specific groups during development and beta testing phases.

4. License Grant

4.1   Subject to your compliance with all terms and conditions of this Agreement, the Company hereby grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and play the Game solely for your personal, non-commercial use.

4.2   This license does not include the right to: (a) reproduce, modify, or create derivative works of the Game or any component thereof; (b) reverse engineer, decompile, or attempt to extract source code from the Game; (c) access the Game through any automated means, bots, or scripts; or (d) use the Game for any purpose not expressly authorized under this Agreement.

4.3   The Company reserves all rights not expressly granted herein.

5. Eligibility

5.1   You must be at least thirteen (13) years of age, or such greater age as required by applicable law in your jurisdiction, to play the Game. By playing, you represent and warrant that you meet this requirement.

5.2   You must maintain a valid Discord account in good standing and comply with all applicable Discord Terms of Service as a prerequisite to using the Game.

5.3   The Company does not knowingly permit access to persons below the applicable minimum age. If the Company becomes aware that a User is under the minimum age, the Account will be terminated immediately.

6. Accounts & Authentication

6.1   The Game uses Discord OAuth2 for authentication. You are responsible for maintaining control of your Discord account. We do not store your Discord password.

6.2   You are responsible for all activity that occurs under your Account. You agree to notify us immediately at the contact information in Section 16 if you suspect unauthorized use of your Account.

6.3   You may not share your Account, sell or transfer it, or create Accounts on behalf of other persons.

6.4   The Company reserves the right to suspend or terminate Accounts that violate this Agreement, engage in cheating or exploitation, or otherwise act in bad faith, without prior notice and without liability.

6.5   Starting with the Beta 2 season, authenticating to the Game additionally requires a linked Arcanum ID account — a separate account/profile system used across Arcanum Forge properties, not specific to this Game. Creating and maintaining an Arcanum ID account is governed by its own Terms of Service and Privacy Policy at arcanum-forge.com/legal/terms/, which apply to that account in addition to this Agreement.

7. Acceptable Use

7.1   You agree that you shall not use the Service to:

1. Use bots, scripts, macros, or any automated means to gain in-game advantages or simulate player activity;
2. Exploit bugs, glitches, or unintended game mechanics — you agree to report such issues to the Company instead;
3. Attempt to access, modify, or interfere with the Game's servers, API, or database;
4. Scrape, harvest, or otherwise collect data from the Game without written authorization;
5. Impersonate any person or entity within the Game;
6. Engage in any conduct that disrupts other players' enjoyment of the Game;
7. Use the Game for any unlawful purpose or in violation of any applicable law or regulation; or
8. Circumvent any technical measures implemented by the Company to protect or limit access to the Game.

7.2   The Company reserves the right, in its sole discretion, to suspend or terminate access to the Service for any User found to be in violation of this Section without prior notice.

8. Virtual Items & Game Economy

8.1   All Virtual Items — including in-game currency, weapons, vehicles, crew members, properties, and any other game assets — are virtual and have no real-world monetary value. You acknowledge that you do not own Virtual Items and that they are licensed to you under this Agreement.

8.2   The Company may modify, rebalance, remove, or reset Virtual Items and game economy at any time without compensation or liability.

8.3   Virtual Items may not be sold, traded, transferred, or exchanged for real-world currency or value outside the Game. Any such transaction is void and may result in Account termination.

8.4   All in-game transactions are final. The Company does not provide refunds for Virtual Items.

9. Intellectual Property

9.1   As between you and the Company, the Company retains all right, title, and interest in and to the Game, including all software, art, design, game mechanics, lore, names, and other components thereof, and all intellectual property rights pertaining thereto.

9.2   The names "Arcan-Mafia," "The Arcanum Forge," and "NodeCore LLC," and any associated logos or marks, are proprietary to the Company. Nothing in this Agreement grants you any right to use such names or marks.

9.3   All game art was generated using AI image generation services and is owned by NodeCore LLC. You may not reproduce or distribute game art without written permission.

10. Disclaimer of Warranties

10.1   THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

10.2   THE COMPANY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GAME DATA WILL BE PRESERVED. THE GAME IS IN ACTIVE DEVELOPMENT AND DATA LOSS OR RESETS MAY OCCUR.

10.3   SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES. TO THE EXTENT SUCH EXCLUSIONS ARE PROHIBITED BY APPLICABLE LAW, SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

11. Limitation of Liability

11.1   TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF GAME PROGRESS, VIRTUAL ITEMS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR YOUR INABILITY TO ACCESS OR USE, THE SERVICE.

11.2   TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THIS AGREEMENT SHALL NOT EXCEED ONE HUNDRED UNITED STATES DOLLARS (USD $100.00).

11.3   SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES; ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

12. Indemnification

12.1   You agree to defend, indemnify, and hold harmless the Company and its officers, directors, members, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your access to or use of the Service; (b) your violation of any provision of this Agreement; or (c) your violation of any applicable law or third-party right.

13. Termination

13.1   This Agreement shall remain in effect for so long as you access or use the Game.

13.2   The Company may suspend or terminate your Account at any time and for any reason, including without limitation your actual or suspected violation of this Agreement, without prior notice and without liability to you.

13.3   You may terminate this Agreement at any time by ceasing all access to and use of the Game and requesting Account deletion via the contact information in Section 16.

13.4   Upon termination, all licenses granted to you under this Agreement shall immediately terminate and you must cease all access to and use of the Service. Sections 1, 8, 9, 10, 11, 12, 14, and 15 of this Agreement shall survive any termination.

14. Governing Law & Dispute Resolution

14.1   This Agreement and all disputes arising out of or related hereto shall be governed by and construed in accordance with the laws of the applicable jurisdiction in which NodeCore LLC is organized, without regard to its conflict of law principles.

14.2   Any dispute, controversy, or claim arising out of or relating to this Agreement shall be resolved by binding arbitration. Notwithstanding the foregoing, either party may seek injunctive relief in any court of competent jurisdiction to prevent irreparable harm.

14.3   TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU HEREBY WAIVE ANY RIGHT TO PARTICIPATE IN ANY CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST THE COMPANY WITH RESPECT TO ANY CLAIM COVERED BY THIS AGREEMENT.

15. Miscellaneous

15.1 Entire Agreement

This Agreement, together with the Privacy Policy, constitutes the entire agreement between you and the Company with respect to the Game and supersedes all prior agreements, understandings, and discussions relating thereto.

15.2 Amendments

The Company reserves the right to modify this Agreement at any time. Modifications become effective upon posting of the revised Agreement at this URL. Your continued use of the Service following modifications constitutes your acceptance of the modified Agreement.

15.3 Severability

If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, or severed, and the remaining provisions shall continue in full force and effect.

15.4 Assignment

You may not assign any of your rights or obligations under this Agreement without prior written consent. The Company may assign this Agreement without restriction.
